Market Overview:

Delaware legalized its medical cannabis market in May 2011 with its first clinic opening in June 2015. Data from BDS Analytics and Arcview Market Research predict that Delaware's medical market will reach $32 million by 2024, and $71 million if adult-use were to pass. Since 2015, the state has attempted to improve the medical program with improved access as well as advocate for adult-use programs.

Requirements & Application Process:

Who qualifies as a Compassion Center Agent?:

Any person who identifies as “a principal officer, board member, employee, or agent of a registered compassion center who is 21 years of age or older and has not been convicted of an excluded felony offense or drug misdemeanor within five years.” The Delaware Code Online, Chapter 49A - The Delaware Medical Marijuana Act

Requirements:

  • 21 years of age or older.
  • Not previously convicted of an excluded felony offense.
Background Check Requirements:

“Every person seeking to become a principal officer, board member, agent, volunteer, or employee of a registered compassion center or a registered safety compliance facility shall obtain a background check…”

A registered Compassion Center cannot employ any person who:

  • Was convicted of an excluded felony offense;
  • Is under 21 years of age;
  • Has been convicted of a misdemeanor drug offense within 5 years from the date of the application.
